The short version: Be honest, be kind, don't use this to harm anyone. Your content is yours. We're here to preserve it. Memorial profiles are permanent. Wills come from your lawyer; we just deliver them.

1.Eligibility

You must be at least 18 years old to create a Capsulated account. By signing up, you confirm you meet this age requirement.

Minors may participate in a family vault only through the Parental Admin feature, where a parent or legal guardian holds the account and gates the minor's outside connections. We do not offer stand-alone accounts to anyone under 18.

2.Account terms

One account per person. You are responsible for keeping your login credentials secure and for everything that happens under your account. You agree to provide accurate information at sign-up — in particular your real legal or commonly-used name, since family-tree integrity depends on it. You agree to notify us promptly if you believe your account has been compromised.

We may verify identifying information (without storing government-issued IDs longer than necessary to complete a verification) when required for security, posthumous-delivery confirmation, or compliance with applicable law.

3.Acceptable use

Capsulated is a private legacy platform. You agree not to:

  • Upload content that is illegal, fraudulent, or that infringes another person's rights.
  • Harass, threaten, or harm any other user, including through messages, contributions, or memorial-page content.
  • Send spam or unsolicited commercial communication through any Capsulated channel.
  • Impersonate another person or create a fake family member, profile, or memorial.
  • Attempt to access vaults, content, or accounts you have not been granted access to.
  • Misuse memorial profiles in any way — including but not limited to defacing memorials, posting unwanted content on them, or attempting to claim them under false pretenses.
  • Use the platform for commercial advertising, lead generation, or any business purpose without our written consent.

We may suspend or terminate accounts that violate these rules. In severe cases — particularly memorial-profile misuse — termination will be immediate.

4.Subscription, billing, refunds

Capsulated offers paid plans (Personal Vault and Legacy Plan) on annual subscriptions, processed by Stripe. Subscriptions renew automatically on the anniversary of your purchase unless cancelled. We will email you a renewal notice at least 7 days before each renewal.

You can cancel at any time from your billing settings. Your access continues through the end of the paid period. Cancelling does not delete your vault — your content remains accessible (read-only) for 30 days, during which you can export everything or resume your subscription.

Refunds. If you cancel within 14 days of an initial subscription purchase and have not used substantial AI Interview minutes or premium features, you can request a full refund. After 14 days, refunds are issued on a prorated basis only at our discretion. We will refund any clearly erroneous charge promptly.

We may change subscription pricing with at least 30 days' notice before your next renewal. You can cancel before the new price takes effect.

5.Storage limits

Each plan includes a defined storage allocation (Personal Vault: 15 GB; Legacy Plan: 50 GB shared among up to 6 creators). When you approach or exceed your limit, we will notify you and pause new uploads until you upgrade your plan, purchase a storage add-on, or remove content.

We will never delete your existing content because of a storage overage. You will always be given the option to upgrade or export before any data loss.

6.Memorial profile permanence

This clause is the central commitment of Capsulated. Read it carefully.

When a vault transitions into a memorial — through Death Activation (see Section 8) — the memorial profile and all content the deceased chose to make part of it become permanent.

A memorial profile cannot be deleted by:

  • The original creator (now deceased), regardless of any prior change-of-mind.
  • The deceased's Trusted Guardians.
  • Surviving family members or other Capsulated users.
  • Capsulated itself.

The only exception is a valid order from a court of competent jurisdiction or a binding legal demand we are required to comply with under applicable law. By creating a vault, you understand and accept that the memorial it may become is intended to outlast you, your designees, and ordinary corporate decisions.

7.Inner Circle and Trusted Guardian responsibilities

Inner Circle members are people you grant ongoing access to your vault. By accepting an Inner Circle invitation, a person agrees to treat the vault contents with discretion and not to redistribute, publish, or otherwise misuse content shared with them.

Trusted Guardians have an additional, more specific role: they are authorised by you to confirm your passing and trigger Death Activation. By accepting Trusted Guardian status, a person agrees:

  • To act in good faith when confirming a death and not to falsely trigger Death Activation.
  • To act in coordination with your other Trusted Guardians, where required by your settings.
  • That confirming a death has legal and operational consequences — including the delivery of posthumous content and the permanent transition of the vault to a memorial.
  • That a fraudulent death-confirmation may be a criminal offence under applicable law.

You may add, remove, or replace Inner Circle members and Trusted Guardians at any time during your lifetime.

8.Death Activation

Death Activation is the process by which Capsulated transitions your vault from a living account to a memorial and delivers the posthumous content you have configured. The full operational details — including triggering paths, grace periods, and recipient notifications — are described in our Privacy Policy.

For these Terms, what matters is:

  • Death Activation is initiated only by the configured paths you set up (Trusted Guardian confirmation, death certificate upload, or inactivity timer). Capsulated does not unilaterally activate death on a vault.
  • Trusted Guardian confirmation, where used, has the legal weight you have granted it through your account settings — meaning Capsulated will rely on it to deliver posthumous content unless an actual legal process intervenes.
  • Once Death Activation completes, the resulting memorial is permanent (see Section 6).

We will not be liable for delivering posthumous content in accordance with your configured settings, even where a surviving family member would have preferred different timing or scope. Configure your settings carefully during your lifetime.

9.Parental Admin

When you add a minor child to your family vault, you accept the role of Parental Admin for that child's connections.

Inner Circle invitations directed at the minor route to you for approval. By approving an outside connection, you confirm that you have considered the request and consent on the minor's behalf. By denying an invitation, you prevent the connection without obligation to explain.

Family-tree connections to blood relatives you have already added are not gated, since you have already vouched for those relatives by adding them to the tree. You are responsible for the integrity of your family tree.

10.Your content and intellectual property

You own everything you upload to Capsulated. We claim no ownership over your photos, voice recordings, videos, written content, memoirs, life-story answers, or any other material you place in your vault.

To operate the service, you grant Capsulated a limited, non-exclusive, royalty-free licence to store, transmit, display, deliver, and process your content solely for the purposes of: showing it to you and the recipients you designate, delivering it on the schedule you configure (including posthumously), and powering the AI features you explicitly use. This licence terminates when you delete the content, with the exception of memorial content (see Section 6).

You are responsible for having the right to upload anything you add to your vault. Don't upload content you don't have the right to use.

11.Wills and legal documents — important disclaimer

Capsulated stores and delivers documents. We do not draft them.

Many users place wills, letters of wishes, durable powers of attorney, trust instruments, insurance policies, and other legal or financial documents in their vaults. Capsulated is purely a custodial and delivery service for these documents. We do not:

  • Draft, prepare, edit, or review your will or any other legal document.
  • Verify the legal validity, execution, or enforceability of any document you upload.
  • Serve as your executor, trustee, attorney-in-fact, or any other fiduciary role.
  • Provide legal advice. Anything we say in product copy, support emails, or this document is not legal advice.

You should engage a licensed lawyer in your jurisdiction to draft and execute your will and any other legally binding instruments. Capsulated's role is to make sure those documents reach the right hands at the right time, exactly as you set up.

If a document you uploaded turns out to be invalid, ambiguous, or superseded by a later instrument we did not receive, that is a matter between you, your lawyer, your estate, and the courts — not Capsulated.

12.Limitation of liability

Capsulated is provided as-is. We make commercially reasonable efforts to keep the service available, secure, and accurate, but we do not guarantee uninterrupted operation. We are not liable for loss of data caused by force majeure, third-party provider outages, or your own actions (deletion, mismanagement of credentials, etc.).

To the maximum extent permitted by law, our total cumulative liability to you for any claim arising out of or relating to these Terms or your use of Capsulated is limited to the amount you paid us in the twelve months immediately preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or punitive damages.

Nothing in this section limits liability that cannot be limited under applicable consumer-protection law.

13.Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Disputes will be brought before the courts located in Toronto, Ontario, except where applicable consumer-protection law in your jurisdiction grants you a non-waivable right to bring proceedings in your local courts.
